Barnwell County Criminal Court Records
Criminal court records in Barnwell County are case-level records. They are not just an arrest note. Once a criminal case is filed, the court record can show the defendant, charge descriptions, statute references, bond, hearing settings, pleas, motions, trial activity, disposition, sentencing orders, probation terms, and appeal entries. For the arrest-to-charge path itself, use the Barnwell County arrest records and court charges page.
South Carolina's Circuit Court has General Sessions for criminal prosecutions. Magistrate and Municipal Courts handle many summary-level criminal, traffic, bond, preliminary hearing, and warrant matters. The Second Judicial Circuit Solicitor prosecutes criminal matters in Circuit Court, Family Court, and some Magistrate Court cases. Barnwell County is in that Second Circuit with Aiken and Bamberg counties.

The SLED CATCH portal is separate. It provides a name-based South Carolina criminal-history check for a fee, but it is not the Barnwell court docket and does not include wanted persons or sex offender checks.
Use SLED CATCH for statewide criminal-history screening and the Public Index for the court case file itself.
Barnwell Criminal Case Flow
A criminal court record changes as the case moves. A charge can start in a warrant, complaint, citation, indictment, or other charging path. Bond and first appearances may involve a Magistrate. More serious cases are prosecuted in General Sessions. A disposition is the outcome of the charge, such as guilty, not guilty, dismissed, or nol prossed.
Case flow: Charges Filed › Arraignment › Pretrial and Motions › Plea or Trial › Disposition › Sentencing
| Stage | What the record may show |
|---|---|
| Charges filed | Charge description, statute, court, case number, and prosecutor action. |
| Arraignment | Formal reading or notice of charges and plea-related activity. |
| Pretrial | Motions, continuances, bond issues, discovery activity, and hearing settings. |
| Plea or trial | Plea entries, verdict, trial events, or withdrawal of prosecution. |
| Disposition and sentence | Outcome, sentence, probation, restitution, fines, costs, or appeal entries. |

The field list below reflects the criminal metadata and public-index categories documented in the research. Barnwell Charges and Convictions
A charge is an accusation filed or pursued in court. A conviction is a finding or admission of guilt. Criminal court records can show both, but they must not be read as the same thing. A case can be dismissed, amended, reduced, nol prossed, or resolved by plea. SLED CATCH may summarize criminal-history information, but the court docket is still the place to inspect case events.
| Charge | Conviction | |
|---|---|---|
| Meaning | An allegation or count filed in a criminal case. | A finding or admission of guilt. |
| Where seen | Public Index, indictment, complaint, warrant, citation, or docket entry. | Disposition, plea, verdict, sentencing, or criminal-history record. |
| Can change | Yes, charges may be amended, reduced, dismissed, or nol prossed. | Usually changes only through appeal, post-conviction relief, pardon, or other legal process. |
The SLED sex offender registry is also separate from criminal case records. The official SLED public sex offender registry and the SLED registry information page are designed for registry searches, not court docket searches.
Registry information may relate to a prior conviction, but it should not be used as a substitute for the court case record.
The SLED sex offender registry landing page provides separate registry guidance.
For a case-level outcome, return to the Barnwell Public Index or the Clerk of Court.
Restricted Barnwell Criminal Records
Juvenile records, sealed files, expunged cases, and some family-related criminal matters are not ordinary public records. S.C. Code Section 63-3-530(D) requires Family Court juvenile records to be kept confidential as prescribed by juvenile and child-protection statutes.
Juvenile confidentiality can block public access even when an adult criminal docket would be searchable.
South Carolina also has expungement statutes. Summary-court matters may be expunged when a person is found not guilty, the charge is dismissed, or the charge is nol prossed, subject to exceptions. Juvenile expungement has a separate path for eligible cases and requires statutory conditions to be met.
| Sealed | Expunged | |
|---|---|---|
| Public access | Hidden from ordinary public access by order or law. | Removed from public access when the law allows. |
| Who may access | Authorized parties or persons with a court order. | Limited agencies may retain nonpublic records where state law requires. |
| Practical step | Ask the court about authority to inspect. | Contact the proper solicitor, clerk, or summary court for process. |
The South Carolina expungement statute page and juvenile statute page are shown in the captured images below.
Expungement eligibility depends on the court, disposition, offense type, and statutory exceptions.
For Barnwell County cases, the practical first step is to identify the exact court, case number, and disposition before asking the Second Circuit Solicitor or summary court about the correct process.
Barnwell Criminal Case Offices
The Second Judicial Circuit Solicitor's Office is the prosecution office for Barnwell County General Sessions cases. South Carolina prosecutors' statewide material identifies the 2nd Circuit Solicitor as Bill Weeks, and the circuit office serves Aiken, Bamberg, and Barnwell counties. The solicitor's role is different from the clerk's role. The solicitor prosecutes; the clerk maintains the public case record, filings, docket entries, and copies.
Public-defense records and appointment questions follow a different track. SCCID says public defenders are appointed by the court for financially indigent criminal defendants. Barnwell County is in Circuit 2, where De Grant Gibbons is listed as Circuit Public Defender and Wallis April Alves is listed for Bamberg/Barnwell chief public defender information in the research. Appointment depends on the criminal case and court approval, not on a public records search.
| Office | Role in criminal records |
|---|---|
| Clerk of Court & Register of Deeds | Maintains court case records, filings, docket entries, dispositions, and certified copies. |
| Second Judicial Circuit Solicitor | Prosecutes criminal matters and may handle eligible expungement or prosecution questions. |
| Public Defender | Represents indigent defendants after court appointment, not general record requesters. |
| Magistrate or Municipal Court | Handles summary charges, bond steps, traffic, warrants, and lower-level criminal matters. |
