Barnwell County's department material says Probate Court issues marriage licenses and has jurisdiction over estates, conservatorships, guardianship of adult incapacitated persons, and involuntary commitment of the mentally ill. Statewide probate material also confirms Probate Court handles wills, trusts, marriage licenses, guardianships, conservatorships, and estate matters.

Probate filings use words that are precise but easy to confuse. These terms help separate estate administration, trust matters, and protective proceedings.

- Guardianship
- A court-supervised role for care or decision-making for an incapacitated adult or minor where allowed.

- The deadline shown in probate results for creditors to make claims against an estate.
Search Barnwell Probate Records
The main online search path is South Carolina Probate Search. The system allows searches by all parties, case name, case number, last name, first name, and middle name. It also supports a percent-sign wildcard before search criteria and uses a gray plus control to expand results when a record is returned.
Probate Search result columns can include case number, case name, party, type of case, filing date, county, appointment date, creditor claim due date, and case status. These fields are enough to confirm many case matches, but they may not provide a full filing packet. The Probate Search field set is more structured than a general court search. Exact case numbers are best. Name searches can be broad, so confirm county, filing date, and case status before treating a result as the right file.
For estates, search both the decedent's name and possible estate case name. For fiduciary questions, review appointment date and status fields before calling the court. For guardianship or conservatorship, expect access limits even when a basic case reference exists.

Barnwell Probate Fees

Restricted Probate Records
Some Barnwell County Probate Court records are not ordinary public records. Involuntary commitment proceedings may involve medical and privacy interests. Guardianship, conservatorship, minor, sealed, and protected-person matters may have limited access. FOIA may help with county-agency records, but it does not override a court seal or confidentiality rule.
Public access can also vary by document type within the same case. A case header or status entry may be visible while supporting medical, financial, minor, or protected-person documents are restricted. Older probate and marriage records may require archives research rather than an online search. South Carolina Archives notes that early Barnwell-related probate and clerk records tied to Orangeburg were destroyed in February 1865, so some historical gaps may not be fixable through a modern request.
South Carolina statutes support the Probate Court's role. S.C. Code Title 62 probate jurisdiction covers probate-code proceedings, Title 62 guardianship provisions cover protected-person jurisdiction, and Trust Code jurisdiction addresses certain trust matters shared with Circuit Court.
Probate and Federal Records
Federal bankruptcy and district court records are separate from Barnwell County Probate Court. A decedent, heir, creditor, or estate-related business may have a federal bankruptcy or civil case, but that does not make the federal docket the probate file. Probate filings, marriage licenses, guardianships, conservatorships, and local estate questions remain with Probate Court unless a separate federal case exists.
Barnwell residents and businesses fall within the federal District of South Carolina for federal cases, and bankruptcy matters use the U.S. Bankruptcy Court for the District of South Carolina.
